Miami Tours and Water Adventures (MTWA) | Effective Date: April 17, 2026
Please read carefully. By booking online, signing electronically, or boarding any vessel, you confirm that you have read, understood, and agree to these terms. MTWA is owner-operated by Felipe and based in Miami Beach. Your safety and a great experience on the water come first, and we’re always transparent about how we operate. Have questions before you book? Just reach out, and we’re happy to help.
1. Weather Policy
Only MTWA or the Captain determines weather cancellations. If MTWA cancels prior to departure due to safety, you receive a full refund or reschedule. If weather interrupts after departure, a pro-rated credit or voucher (valid 15 months) may be issued. Safety decisions are made near departure time.
Book With Confidence – Cancellation Policy
We understand that plans can change—and we want you to feel comfortable reserving your adventure with us. To balance flexibility for our guests while reserving our vessels, captains, and crew exclusively for your booking, the following policy applies:
- Free Cancellation: Cancel 7 days or more before your scheduled departure and receive a 100% full refund.
- Flexible Changes: Cancel more than 72 hours but less than 7 days before departure and receive a 50% refund of the total amount paid.
- Last-Minute Changes: Cancellations made within 72 hours of departure are non-refundable. However, at our sole discretion and subject to availability, we may allow a one-time reschedule within 15 months of the original tour date.
- No Shows: Failure to arrive for your scheduled departure without written cancellation confirmation will be considered a No Show. No Shows are non-refundable and non-transferable.
How to Cancel
All cancellations must be submitted in writing via email to Miamiwateradventures@outlook.com and are only valid once confirmed in writing by MTWA.
Refund Processing
- Your date stays reserved for you until your scheduled departure, so if your plans change, you’re still welcome to join us on your original date at no extra cost. Just let us know in writing before departure.
- Eligible refunds are reviewed and processed within 3–5 business days after your original tour date.
- Depending on your bank, it may take an additional 7–10 business days for the funds to appear in your account.
- Non-refundable merchant processing fees may be deducted where permitted by law.
2. Assumption of Risk
I understand that boating, jet ski rentals, bareboat charters, snorkeling, swimming, and related water sport activities involve inherent risks including but not limited to: drowning, slipping or falling onboard, vessel collision, changing tides, wakes, currents, marine life encounters, and operator or participant error. I voluntarily assume all known and unknown risks, except those caused solely by gross negligence.
3. Release of Liability & Indemnification
In consideration for being allowed to participate, I agree to:
- Release and hold harmless Miami Tours and Water Adventures (MTWA), vessel owners, captains, crew, employees, and agents.
- Waive all claims for injury, loss, property damage, or wrongful death.
- Indemnify and defend MTWA from any claims brought by me, my guests, heirs, or representatives.
4. Vessel Capacity & Charter Options
Vessel Capacity & Compliance: We offer three ways to charter, so every group sails safely and legally:
- Commercially licensed vessels (up to 6 guests): These operate commercially with a USCG-licensed captain provided. No charter agreement is required.
- Bareboat charters (up to 12 guests): The Charterer takes possession of the vessel under a Bareboat Charter Agreement and selects their own USCG-licensed captain (see Captain Selection below).
- U.S. Coast Guard inspected vessels (more than 12 guests): Larger groups sail aboard Coast Guard inspected and approved vessels, such as our 80′ Solstice for up to 45 guests.
Every vessel is matched to your group size and we never exceed its legal capacity, so you’re protected and covered from booking to return.
Captain Selection (Bareboat Charters): Under a bareboat charter, you (the Charterer) hire your own USCG-licensed captain. You may choose from a list of three or more independent licensed captains we can suggest, or hire any other USCG-licensed captain of your choice. The captain works for you, not MTWA, and is engaged under a separate agreement. MTWA acts solely as a booking facilitator and is not the vessel operator during a bareboat charter.
5. Billing, Care of Equipment & Damage Responsibility
The credit card used to book must be presented with matching government-issued ID at check-in. We want you to have an amazing time, and we trust you to treat our equipment like your own. Jet skis, snorkel gear, and wakeboard and wakesurf boards are all in your care during your adventure. The same goes for our yacht and boat interiors, including upholstery, cushions, flooring and fixtures. Accidents can happen, but damage to equipment or interiors caused by misuse or by not following your captain’s or guide’s instructions is the guest’s responsibility. In those cases, the actual cost of repair or replacement will be charged to the card on file. Lost equipment, excessive cleaning, overtime and marina fines caused by guests may also be charged. For group bookings, all participants share responsibility. Follow your briefing, ask questions anytime, and enjoy the water!
6. Late Arrival & No-Show Policy
Guests must arrive 30 minutes prior to departure. No make-up time is provided for late arrivals. If you have not arrived or contacted us by 30 minutes after your scheduled departure time, you will be considered a No Show. No Show = No refund and no rescheduling.
7. 💰 Gratuity
Gratuity is not included. A suggested minimum gratuity is 15 to 20%, paid directly to the captain. You may add it to the card on file, pay with cash, or use any payment app, whichever is most convenient for you.
8. ⛽ Fuel, Food & Beverages
Fuel is included. Guests may bring their own snacks and drinks if desired, unless noted otherwise. On certain vessels for larger parties where the charter agreement includes an open bar, outside alcohol is not permitted.
9. 📝 Waivers
Please complete and sign the electronic waiver prior to check-in, and ensure that all participants have done the same.
10. 🪪 What to Bring

14. Security Screening – Federal Compliance
For the safety of all guests and crew, boarding constitutes consent to screening or inspection of persons and belongings. Refusal will result in denial of boarding without refund.
15. Broker Disclosure
MTWA may act solely as a booking agent for certain vessels and activities. MTWA is not responsible for vessel owner decisions, captain navigation decisions, or events beyond its direct control.
16. Dispute Resolution & Governing Law
This Agreement is governed by the laws of the State of Florida. The exclusive venue for disputes is Miami-Dade County, Florida. I agree not to initiate a credit card chargeback in violation of this agreement.
17. Media Release
I grant MTWA permission to use photos or videos taken during activities for marketing purposes unless I notify staff in writing prior to departure.
18. Electronic Acceptance
By clicking “I Agree,” completing an online booking, or boarding the vessel, I confirm I have read and understood this Agreement, accept all policies including cancellation terms, and agree that this electronic acceptance is legally binding.
