This Privacy Policy explains how MTWA (Miami Tours and Water Adventures) (“MTWA”, “we”, “us”, “our”) collects, uses, shares and protects personal information when you visit miamitoursandwateradventures.com, contact us, or book a private boat tour, snorkeling trip, jet ski rental, yacht charter or catamaran charter with us. It also explains your rights and how to use them.
Many of our guests visit from the European Union, the United Kingdom and Canada, so this policy is written with those privacy laws in mind as well as US law.

Our Lenox Avenue address is an administrative office only, not a departure point. Please do not visit it. Your confirmed departure point, date and time are sent with your booking confirmation.
2. Information we collect
Information you give us
- Identity data: your full name and, if requested for safety or rental requirements, details from a government-issued ID.
- Contact data: email address and phone number, used for booking confirmations, logistics, and weather or safety updates.
- Booking data: the tour or charter you choose, date, time, group size, participant details needed for the trip, and any special requests.
- Safety information you choose to share: for example swimming ability or a health condition relevant to an activity.
- Payment data: card payments for deposits, service fees and security authorizations are processed by our booking and payment provider, Peek. We do not store full card numbers.
- Communications: what you send us through our contact form, email, phone or messaging apps, and any reviews or feedback.
- Waivers or safety forms you complete for your trip.
Information collected automatically when you use our website
- Device and usage data: IP address, browser and device type, pages viewed, links clicked, referring website, and approximate location (such as city or country) derived from your IP address.
- Cookies and similar technologies: see Section 9 and our Cookie Policy. Analytics cookies (Google Analytics 4) are only used if you agree to them.
Information from others
- When you book through the “Book Now” tool on our website, Peek sends us your booking and payment status.
- If someone else books on your behalf, for example a member of your group, they may give us your name and the details needed for the trip.
3. How we use your information and our legal bases
If you are in the EU/EEA or UK, the GDPR or UK GDPR requires us to have a legal basis for each use of your data. Both are shown below.

When we rely on legitimate interests, we have weighed them against your rights, and you can object at any time (see Section 8). We do not make decisions about you based solely on automated processing.
4. Who we share your information with
We share personal information only as needed for the purposes above. We use the following service providers:

Some of these providers, such as Peek and Google, also handle certain data under their own privacy policies (see Section 10).
We may also share information:
- with the captains and crew running your trip, only as needed to run it;
- with authorities, such as maritime, wildlife or law enforcement agencies, where the law requires it or to protect someone’s safety;
- with professional advisers, such as lawyers, accountants and insurers, under confidentiality;
- with a buyer or successor if our business is sold or reorganized, who must protect it as described here.
5. We do not sell or share your personal information
We do not sell, rent or trade your personal information. We do not share it for cross-context behavioral (targeted) advertising, as those terms are defined under California and other US state privacy laws. We do not use advertising or remarketing cookies, and we do not use the Meta (Facebook) pixel.
Do Not Sell or Share: Although we don’t sell or share personal information, you can send us an opt-out request at any time. Email info@miamitoursandwateradventures.com with the subject “Do Not Sell or Share” and we will honor and record your request.
6. International transfers
We are based in the United States, and our service providers process data mainly in the United States and in other countries where they operate. If you are visiting from the EU/EEA, UK, Switzerland, Canada or elsewhere, your personal information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
We transfer personal information with appropriate safeguards, such as Standard Contractual Clauses or the EU-US Data Privacy Framework (including its UK Extension and the Swiss-US framework) where applicable. Some transfers are also necessary to carry out the booking you request. Contact us if you would like more information about these safeguards.
7. How long we keep your information
We keep personal information only as long as needed for the purposes described in this policy, including legal, tax and accounting requirements. After that, we delete it or anonymize it. In practice:
- Booking, payment and transaction records are kept as long as required for tax, accounting and legal purposes.
- ID details and safety information are kept only as long as needed for your trip and any applicable safety, maritime or rental record-keeping requirements.
- Waivers and incident records are kept as long as needed to meet legal requirements and to handle any claims.
- Inquiries that don’t lead to a booking are kept only as long as needed to answer you and follow up.
- Marketing email preferences are kept until you unsubscribe. After that we keep only a record of your opt-out.
- Analytics data is kept according to our Google Analytics retention settings.
- Cookies last for the periods listed in our Cookie Policy.
Peek and our other providers may keep data under their own retention schedules.
8. Your privacy rights
To make any of the requests below, email info@miamitoursandwateradventures.com or call (305) 772-9942. We respond within the time the applicable law requires: generally one month under the GDPR/UK GDPR, 30 days under Canadian law, and 45 days under US state laws. We may need to verify your identity first. Requests are free unless they are clearly unfounded or excessive. Where the law allows, you can use an authorized agent.
Everyone can:
- ask to access the personal information we hold about you and get a copy;
- ask us to correct inaccurate information;
- ask us to delete your information after your trip, unless we must keep it, for example for maritime, tax, accounting or legal-claim reasons;
- opt out of marketing emails at any time, using the unsubscribe link or by contacting us (operational and safety messages about an active booking will continue);
- manage or withdraw cookie consent at any time (see Section 9).
If you are in the EU/EEA or UK (GDPR / UK GDPR), you also have the right to:
- restrict, or object to, processing based on our legitimate interests;
- data portability, meaning you can receive the data you gave us in a commonly used format;
- withdraw your consent at any time, without affecting earlier processing;
- lodge a complaint with a supervisory authority: in the EU, the data protection authority in your country; in the UK, the Information Commissioner’s Office. We would appreciate the chance to resolve your concern first.
If you are in Canada (PIPEDA and provincial laws such as Quebec’s Law 25), you can access and correct your personal information and withdraw consent, subject to legal or contractual limits. You can also complain to the Office of the Privacy Commissioner of Canada or your provincial regulator, such as Quebec’s Commission d’accès à l’information. If you live in a US state with a consumer privacy law (for example California, Virginia, Colorado, Connecticut or Texas), you may have the right to know about, access, correct, delete and get a copy of your personal information. You may also have the right to opt out of its sale or sharing, targeted advertising and certain profiling. As explained in Section 5, we don’t sell or share personal information or use it for targeted advertising. If we deny your request, you can appeal by replying to our decision or by emailing info@miamitoursandwateradventures.com with the subject “Appeal”. We will not discriminate against you for using your rights.
Florida: We are a small Florida-based business. We believe the Florida Digital Bill of Rights doesn’t apply to us, because it mainly covers much larger companies. We voluntarily follow its core principles: transparency, no sale of personal data, and honoring requests to access, correct and delete data.
9. Cookies and analytics
We use a cookie banner to ask for your consent before setting non-essential cookies. Google Analytics stays off until you accept (Google Consent Mode v2 defaults to “denied”). You can change your choice at any time using the cookie preferences (gear) button at the bottom-left of any page. You can also email us to opt out, and we will honor your request.

10. Third-party websites and booking tools
Our website includes the Peek booking tool, Google Maps and Google reviews, and links to other websites and social media. These third parties may collect information under their own privacy policies, which we don’t control. Please review them, for example Peek’s Privacy Policy and Google’s Privacy Policy.
11. Children
Our website is not aimed at children. We do not knowingly collect personal information online from children under 13 (or under 16 in the EU/UK). Minors may join our tours with a parent or guardian, who provides any information needed about the child for safety and boarding. If you believe a child has sent us personal information without a parent’s consent, please contact us and we will delete it.
12. How we protect your information
We use reasonable administrative, technical and physical safeguards suited to a small business. These include:
- using established providers for booking, payments and hosting;
- using secure (HTTPS) connections on our website;
- limiting access to guest information to the people who need it to run your trip;
- keeping safety-sensitive information under the direct oversight of our team.
Card payments are handled by Peek, and we do not store full card numbers. No method of transmission or storage is 100% secure. If a data breach affects your personal information, we will notify you and the relevant authorities where the law requires it.
13. Changes to this policy
We may update this policy from time to time, for example when we add a new booking or website service. We will post the updated version on this page and change the effective date at the top. If the changes are significant, we will also give more prominent notice, for example on our website or by email to guests with upcoming bookings.
