Miami Tours and Water Adventures (MTWA) Effective Date: April 17, 2026
Please read carefully. By booking online, signing electronically, or boarding any vessel, you acknowledge that you have read, understood, and agreed to the following legally binding terms. Managed by Felipe at our Miami Beach headquarters (429 Lenox Avenue), our operations are governed by a commitment to guest safety and radical transparency. We encourage all guests to review our verified safety and methodology protocols to understand the standards behind our private maritime experiences.
🌴 Book With Confidence – Cancellation Policy
We understand that plans can change—and we want you to feel comfortable reserving your adventure with us. To balance flexibility for our guests while reserving our vessels, captains, and crew exclusively for your booking, the following policy applies:
- ✅ Free Cancellation: Cancel 7 days or more before your scheduled departure and receive a 100% full refund.
- ✅ Flexible Changes: Cancel 3–6 days before departure and receive a 50% refund of the total amount paid.
- 🔁 Last-Minute Changes: Cancellations made within 72 hours of departure are non-refundable. However, at our sole discretion and subject to availability, we may allow a one-time reschedule within 12 months of the original tour date.
- 🚫 No Shows: Failure to arrive for your scheduled departure without written cancellation confirmation will be considered a No Show. No Shows are non-refundable and non-transferable.
How to Cancel
All cancellations must be submitted in writing via email to Miamiwateradventures@outlook.com and are only valid once confirmed in writing by MTWA.
Refund Processing
- Refunds are processed within 5–7 business days after the scheduled tour date.
- Banks may require an additional 3–10 business days to reflect funds.
- Non-refundable merchant processing fees may be deducted where permitted by law.
1. Assumption of Risk
I understand that boating, jet ski rentals, bareboat charters, snorkeling, swimming, and related water sport activities involve inherent risks including but not limited to: Drowning, slipping or falling onboard, vessel collision, changing tides, wakes, currents, marine life encounters, and operator or participant error. I voluntarily assume all known and unknown risks, except those caused solely by gross negligence.
2. Release of Liability & Indemnification
In consideration for being allowed to participate, I agree to:
- Release and hold harmless Miami Tours and Water Adventures (MTWA), vessel owners, captains, crew, employees, and agents.
- Waive all claims for injury, loss, property damage, or wrongful death.
- Indemnify and defend MTWA from any claims brought by me, my guests, heirs, or representatives.
3. Bareboat Charter Disclosure (USCG Compliant)
Certain vessels in our fleet may operate as Bareboat Charters under U.S. Coast Guard regulations. Under a bareboat charter, the Charterer assumes full possession and operational control of the vessel and selects/pays the captain directly. MTWA acts solely as a booking facilitator and is not the vessel operator during a bareboat charter.
4. Billing, Charges & Damage Responsibility
The credit card used to book must be presented with matching government-issued ID at check-in. I authorize MTWA to charge the card on file for: Damage to vessel/equipment, lost equipment, excessive cleaning, overtime use, or marina fines caused by guests. For group rentals, all participants accept joint responsibility for damages.
5. Late Arrival & No-Show Policy
Guests must arrive 30 minutes prior to departure. No make-up time is provided for late arrivals. If we do not hear from you within 30 minutes of departure, you are considered a No Show. No Show = No refund and no rescheduling.
6. Weather Policy
Only MTWA or the Captain determines weather cancellations. If MTWA cancels prior to departure due to safety, you receive a full refund or reschedule. If weather interrupts after departure, a pro-rated credit or voucher (valid 15 months) may be issued. Safety decisions are made near departure time.
7. Safety & Conduct Requirements
- Children 12 and under must wear life jackets while underway on upper decks.
- Guests must follow captain and crew instructions at all times.
- Unsafe, disorderly, or destructive behavior may result in termination without refund.
- Illegal substances are strictly prohibited.
8. Fitness to Participate
I certify that I am physically and mentally fit to participate and not under the influence of drugs or alcohol. Parents or guardians accept full responsibility for minors.
9. Security Screening – Federal Compliance
Pursuant to 33 CFR 104.25, boarding constitutes consent to screening or inspection of persons and belongings. Refusal will result in denial of boarding without refund.
10. Broker Disclosure
MTWA may act solely as a booking agent for certain vessels and activities. MTWA is not responsible for vessel owner decisions, captain navigation decisions, or events beyond its direct control.
11. Dispute Resolution & Governing Law
This Agreement is governed by the laws of the State of Florida. The exclusive venue for disputes is Miami-Dade County, Florida. I agree not to initiate a credit card chargeback in violation of this agreement.
12. Media Release
I grant MTWA permission to use photos or videos taken during activities for marketing purposes unless I notify staff in writing prior to departure.
13. Electronic Acceptance
By clicking “I Agree,” completing an online booking, or boarding the vessel, I confirm I have read and understood this Agreement, accept all policies including cancellation terms, and agree that this electronic acceptance is legally binding.
